  • A refusal to register based on a likelihood of confusion with a registered trademark for goods or services related to yours
  • An opposition proceeding to prevent registration of your United States Patent and Trademark Office (USPTO)-approved trademark or a cancellation proceeding against your trademark registration
  • A trademark infringement lawsuit

Once you have applied for and received a Trademark Registration, you need to use it properly and protect it. Using it properly means using the Mark  as it is registered. If the mark "JAMES" is registered for use with sandwiches, always use the mark as JAMES. Do not use JAMES's to show possession, and do not use a nickname, "JIMMY".

To protect your mark,  you must file a Section 8 declaration, specimen of use, and a fee on specific anniversaries of the registration. In this way, your registration may stay registered forever.  

You also must use demand letters and litigation to prevent others from using your goodwill.
